Learn These Terms, Regardless Of The Erp You Choose

The purpose of #buildTRUTH is to protect contractors from harmful tactics. Whether you choose Plexxis or another provider, the terms below will help you build fair agreements. Your effort to #BuildTRUTH helps set higher standards for shared risk and accountability in contruction technology.

Unfair Subscriptions

Unfair Subscriptions

Unfair subscriptions have an imbalance of rights, obligations, including a lack transparency on total cost, misrepresentation of products & services, and failure to provide options for cancellation without penalty.

Include these safeguards in your agreement:

  1. Client may cancel agreement at any time (any payments made are non-refundable)
  2. Software provider shall commit a detailed plan, including a complete list of tasks, commitments, milestones and hours required for successful onboarding.
  3. Software provider shall defer software payments until client is live. "Live" is achieved when all four of the following critical milestones are met:
    1. AP payments are paid through software.
    2. Payroll runs (and/or) Payroll service export/integration is completed through software.
    3. Client is posting to the GL.
    4. Entry of historical AIA/progress billings details to enable accurate retention billing.

Smoke Stacking

Smoke Stacking

Smoke Stacking occurs when software providers oversell the level of integration of products in a tech stack.

Include this safeguard in your agreement:

  1. Integrations between products are integrated to the level represented in sales demonstrations with no additional fees outside contract.

R&D Redirection

R&D Redirection

R&D Redirection occurs when software vendors collect similar fees from customers in multiple industries and sectors while functions and workflows mostly benefit a core group of customers ( i.e.: GC’s only ).

Include this safeguard in your agreement:

  1. Ensure annual support fees are aligned with demonstrated value delivered over previous 3 years of functions in product's release notes.

Cloud Cuffing

Cloud Cuffing

Cloud Cuffing occurs when software providers keep client data hostage in order to collect more money than what is already owed and/or agreed to, esentially forcing clients into unreasonable extensions or renewals of subscriptions when converting to other software.

Include this safeguard in your agreement:

  1. Software provider shall include a lifetime user license for licensed products, or tools for extracting and packaging client data in usable formats.

Overages & Overruns

Overages & Overruns

Overages & Overruns occur when vendors mislead on cost and complexity of deployment.

Include this safeguard in your agreement:

  1. Software provider shall commit a complete deployment plan with GMP for successful GO-LIVE.
